These Terms of Service govern purchases made through clockedoutpc.com. The website is operated by Clocked Out PC LLC. By accessing the website, submitting an order, or purchasing a product, you agree to these Terms and our applicable Return and Refund Policy, Shipping Policy, Privacy Policy, and Limited Warranty Policy.

1. Eligibility and Acceptance

You must be at least 18 years old or have the authorization and involvement of a parent or legal guardian to place an order.

An automated order confirmation only confirms that we received your order. It does not guarantee acceptance. Clocked Out PC LLC may review, verify, accept, reject, or cancel an order before shipment or before work begins on a custom system.

2. Products and Descriptions

We make reasonable efforts to accurately display product descriptions, specifications, condition, photographs, pricing, and availability.

Actual product appearance may vary slightly because of lighting, display settings, component revisions, or manufacturer changes. Any material component substitution will be equal to or better than the originally listed component and will not materially reduce the system’s intended performance. We will request customer approval before making a material substitution when reasonably necessary.

Customers are responsible for reviewing the full product description, specifications, condition, warranty coverage, and applicable policies before ordering.

3. New, Pre-Owned, and Open-Box Components

A product listing will identify whether a system or component is new, pre-owned, refurbished, open-box, or otherwise subject to special conditions.

New components may include separate manufacturer warranties. Pre-owned, refurbished, or open-box components are not guaranteed to include a manufacturer warranty unless expressly stated in the product listing.

4. Pricing and Payment

Prices are shown in U.S. dollars and may change without notice before an order is accepted.

Applicable taxes, shipping costs, and other charges will be shown at or before checkout when available.

Payments are processed through Shopify Payments or another payment provider offered at checkout. Clocked Out PC LLC does not directly collect or store full card numbers, CVV security codes, card expiration dates, or complete payment credentials.

We may cancel or correct an order affected by an obvious pricing, description, inventory, discount, or technical error. If payment has already been collected for a canceled order, the amount collected will be refunded to the original payment method.

5. Order Verification and Fraud Prevention

Clocked Out PC LLC may delay, reject, or cancel an order when reasonably necessary to verify payment, identity, billing information, shipping information, product availability, or suspected fraud.

We may request additional information before accepting a high-value or unusual order. Failure to provide reasonably requested verification may result in cancellation and refund of the unfulfilled order.

We may restrict shipment to the verified address associated with the order or payment method.

6. Custom-Built and Special-Order Systems

Custom-built, build-to-order, specially configured, personalized, and special-order systems are created or obtained specifically for the customer.

Once the order has been accepted and component purchasing, configuration, assembly, or other custom work has begun, the order is final sale and may not be canceled, returned, or refunded for buyer’s remorse.

Clocked Out PC LLC may approve an exception in writing at its sole discretion. Any approved cancellation or return may be subject to costs already incurred, payment-processing charges where permitted, nonreturnable component costs, labor, shipping, and the restocking or loss-in-value deductions stated in our Return and Refund Policy.

A custom system may still qualify for an applicable remedy if it is materially different from its listing, contains an incorrect item, arrives with verified shipping damage, has a covered workmanship defect, or applicable law requires a remedy.

7. Ready-to-Ship Products

Eligible ready-to-ship products may be returned only in accordance with our Return and Refund Policy.

A 30% restocking fee applies to approved buyer’s-remorse returns unless a different term is clearly stated before purchase. The buyer is responsible for return shipping and any loss in value resulting from use, damage, modification, missing materials, or improper packaging.

8. Shipping and Delivery

Processing times, build estimates, shipping methods, delivery requirements, address errors, insurance, and transit-damage procedures are governed by our Shipping Policy.

Delivery dates are estimates unless expressly guaranteed in writing.

If we cannot ship within the promised period, we will provide a revised estimate and any cancellation or refund option required by applicable law.

The customer is responsible for providing a complete and accurate delivery address and for making reasonable arrangements to receive a signature-required shipment.

9. Inspection and Transit Damage

Customers should inspect their order promptly after delivery.

Visible shipping damage, missing items, or a system that is non-functional upon delivery should be reported within 48 hours to clockedoutpc@gmail.com. Customers must retain the shipping box, internal packaging, shipping label, and protective materials and provide reasonably requested photographs or video.

The 48-hour reporting period assists us with carrier claims but does not eliminate rights that cannot legally be waived.

10. Returns and Product Identification

Returns require prior authorization and are governed by our Return and Refund Policy.

Clocked Out PC LLC may record system SKUs, serial numbers, component serial numbers, part numbers, model numbers, hardware specifications, photographs, and test records.

A return or refund will be denied if a returned product or component has a different or unverifiable SKU, serial number, part number, or model number; has been swapped, substituted, removed, or replaced; was not originally included in the order; or has an altered, removed, damaged, or unreadable identification label.

Suspected component swapping, return fraud, chargeback fraud, or other deceptive activity may be reported to the payment provider, carrier, insurer, marketplace, or appropriate authorities.

11. Limited Warranty

Warranty coverage varies by product and is stated in the product listing or applicable Limited Warranty Policy.

Unless otherwise stated, eligible fully built PCs include a one-year limited labor warranty. This is a labor-only warranty and does not include replacement parts, free shipping, packaging, manufacturer fees, or other expenses unless expressly stated or required by law.

Manufacturer warranty coverage is controlled by the applicable manufacturer and is not guaranteed by Clocked Out PC LLC.

12. Pre-Shipment Testing

Every fully built PC is inspected and tested before shipment. Testing may include startup verification, CPU and GPU load testing, memory and storage checks, temperature monitoring, hardware verification, benchmark testing, and general stability testing.

Each fully built system includes a Startup Guide and an Inspection Sheet identifying the tests performed on that particular system. The Inspection Sheet may include recorded temperatures, benchmark scores, hardware information, and test results.

These records document performance at the time of testing. They do not guarantee that components will never fail or that every program, game, update, peripheral, setting, or operating environment will produce identical results.

13. Customer Modifications and Data

Customers are responsible for backing up important files before returning a system for diagnosis, repair, or warranty service.

Clocked Out PC LLC is not responsible for issues caused by misuse, accidental damage, liquid damage, electrical problems, malware, incompatible software, customer-installed components, unauthorized modification, improper repair, overclocking, BIOS changes, or other conditions excluded under the applicable Limited Warranty Policy.

Opening the case or performing routine maintenance does not automatically void warranty coverage. However, damage caused or contributed to by customer or third-party work is not covered.

14. Prohibited Website Use

You may use this website only for lawful purposes and legitimate interaction with Clocked Out PC LLC.

You may not use the website, our business information, customer-facing materials, or services to:

• Commit or assist fraud, theft, chargeback abuse, return fraud, identity misuse, or other unlawful activity;

• Submit false, misleading, impersonated, or unauthorized information;

• Attempt to gain unauthorized access to the website, customer accounts, administrative systems, payment systems, or connected services;

• Interfere with website security, availability, performance, checkout, pricing, inventory, or order processing;

• Introduce malware, malicious code, automated attacks, or harmful technology;

• Scrape, harvest, copy, monitor, download, or collect website content or data through automated means without prior written authorization;

• Use our website, policies, contact information, product listings, photographs, or business identity to impersonate Clocked Out PC LLC or falsely suggest an affiliation, endorsement, or partnership;

• Use the website to harass, threaten, deceive, exploit, or harm Clocked Out PC LLC, its customers, service providers, or other persons;

• Circumvent order limits, fraud controls, security measures, or access restrictions; or

• Use any Clocked Out PC LLC information for spam, phishing, scams, unauthorized solicitation, or abusive commercial activity.

Clocked Out PC LLC may restrict access, cancel affected orders, preserve relevant records, and report suspected unlawful or abusive conduct to payment providers, hosting providers, carriers, insurers, law-enforcement authorities, or other appropriate parties.

15. Intellectual Property and Business Content

The Clocked Out PC name, branding, original photographs, videos, graphics, product descriptions, written policies, Startup Guides, Inspection Sheets, test records, and other original content created by or for Clocked Out PC LLC are owned by Clocked Out PC LLC or used under applicable license.

Certain website themes, fonts, software, manufacturer images, product names, logos, trademarks, and other third-party materials may be owned by their respective licensors or rights holders.

Unless prior written permission is provided, you may not reproduce, republish, distribute, modify, sell, license, commercially exploit, or create misleading derivative use of these materials.

You may not copy our product listings, photographs, testing information, or written materials for use in another store, marketplace listing, advertisement, website, social-media account, or commercial service.

You may not remove ownership notices, watermarks, trademarks, copyright notices, or other identifying information from our materials.

Nothing in these Terms restricts lawful consumer reviews, commentary, news reporting, legally protected fair use, or other rights that cannot lawfully be restricted.

Third-party product names, logos, photographs, and trademarks remain the property of their respective owners.

16. Performance Estimates and Disclaimer

Except for express written warranties provided by Clocked Out PC LLC and rights that cannot legally be excluded, the website and its content are provided on an “as available” basis.

Any FPS figures, gaming-performance estimates, benchmark estimates, temperature estimates, compatibility information, and similar performance claims shown on the website are approximate and provided for general reference only unless expressly identified as results from a specific tested system.

Actual results may vary based on the game or software version, resolution, graphics settings, drivers, operating-system updates, ambient temperature, airflow, background applications, connected devices, hardware variation, and customer configuration.

Benchmark scores, temperatures, and test results listed on a system’s Inspection Sheet reflect the results recorded for that specific system at the time of testing. They do not guarantee identical future performance or results under different operating conditions.

Build times, processing times, and delivery dates are estimates unless expressly guaranteed in writing.

No performance estimate, product description, customer communication, or other statement creates a guarantee unless it is expressly identified as part of a written warranty provided by Clocked Out PC LLC.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Clocked Out PC LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages, including lost data, lost profits, business interruption, lost use, or the cost of substitute equipment.

For claims arising from a website purchase, Clocked Out PC LLC’s total liability will not exceed the amount paid for the product giving rise to the claim, except where applicable law does not permit that limitation.

These limitations do not exclude liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or certain personal injuries.

18. Indemnification

To the extent permitted by law, you agree to be responsible for losses, liabilities, and reasonable costs arising from your unlawful use of the website, fraudulent activity, violation of these Terms, or infringement of another person’s rights.

This section does not require a consumer to indemnify Clocked Out PC LLC for our own unlawful conduct, negligence, or breach of these Terms.

19. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except to the extent that the non-waivable consumer-protection laws of another jurisdiction apply.

Any dispute that cannot be resolved informally will be handled by a court of competent jurisdiction, subject to applicable jurisdiction and venue requirements.

Before filing a claim, customers are encouraged to contact clockedoutpc@gmail.com and provide a reasonable opportunity to investigate and resolve the issue.

20. Policy Changes

Clocked Out PC LLC may update these Terms to reflect changes in our business, website, products, or legal obligations.

The version in effect when an order is accepted will generally govern that order. Updated Terms will apply to future website activity and purchases after they are posted.

21. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted or removed, and the remaining provisions will remain in effect.

22. Entire Agreement

These Terms, together with the applicable product listing, order confirmation, Return and Refund Policy, Shipping Policy, Privacy Policy, and Limited Warranty Policy, constitute the agreement governing website purchases from Clocked Out PC LLC.

If a specific written product listing or order agreement conflicts with these general Terms, the more specific written term will control for that order, subject to applicable law.
